Problems wih FSA--Need assistance asap.
Too keep this short...We have been having difficulties with Farm Service Agency since we started dealing with them in 2005. My parents were part of the Pigford Claim. Now we have the same loan officers that discriminated against them. I need some advice on what to do about the situation. As with my parents and other black farmers, we have continued to get our loans too late and FSA seems to not be willing to help us keep our farm operating. I have to know more than them in order to get anywhere. So I am always on the internet, reading gov't policies and procedures. We have already generated National attention with our first dealings with FSA. In February 2005, we applied for loan programs and did not receive them until March of 2006. We were denied over a manure cost that we did not have, but the FSA loan officers told us we had to have because no one gets anything for free. We filed an appeal and won. Then in 2007, we applied for restructure servicing and operating money for 2007. We were given approval on May 25, 2007 only if we met 15 stipulations (crops need to be in the ground by June 15th). So we refused the loan and accepted the restructure. We were told we could not do that. We filed an appeal and lost. Our appeal was based on the fact that we could have restructured our loans before they became deliquent under distressed farmers, but no one advised us of this when we called to say we could not make the total loan payment. We lost because we should have requested the restructure on our own before January 1st. There is a lot to this story and I am very frustrated because we just started farming in 2005 under FSA and we are now faced with losing our farm after 2 years. We are the only black owned organic farm in this area (Southwestern Lower Michigan). These loan officers have been trying to get my father out of farming for years and now that I have taken over the family farm they are trying to do the same to me it seems. My father and another farmer that has had recent problems with FSA said that we should file a lawsuit against them. I am considering it but I don't know of any experienced agriculture lawyers in this area. I need some help from somewhere with this situation. Please help!! |
